A hot potato for investors. Polish Deal vs. the amendment to the Construction Law

The authorities that had so far exercised control and supervisory powers in the field of building law with regard to houses without a building permit, have been almost completely deprived of them. The amendment to the Construction Law and the Act on Spatial Planning and Development, implementing the announcements of the Polish Deal, is to enter into force on January 3, 2021, howere it does not apply to "small houses".

Fast Track, i.e. a new system for registering trademarks and industrial designs. Review of the procedure

Introduction of a system of accelerated registration of trademarks and industrial designs, called Fast Track procedure, is a considerable change for persons applying for marks and designs directly and for their professional representatives in proceedings before the Patent Office of the Republic of Poland. Business activity is often run by two partners in the form of a general partnership. However, there may be a conflict between them. Will the submission by one of the partners of a declaration on termination of the deed of partnership lead to its dissolution?

Rules for supplementing offer-related evidence

With the entry into force of the new public procurement law, the rules for supplementing offer-related evidence in the course of a public procurement procedure have changed. Technical specifications of equipment, datasheets, certificates, documents filled in by the contractor describing features of delivered devices, etc., because this is what we mean here, are submitted to prove that offered supplies, services or works meet contracting authority's requirements.

Management board acts independently, but also bears responsibility

The supervisory board and shareholders are not entitled to issue binding instructions to the management board of a limited liability company regarding the conduct of its affairs. They can only address non-binding recommendations to the management board.
