GWW successfully advises the local community in Zieleniec

The Voivode of Lower Silesia accepted the application submitted by GWW and issued a decision on the cancellation of the permit for construction of a 14-story apartment building in Zieleniec, which is being built on one of the nearby slopes. The local community is of the opinion that the investment poses a threat to the environment and water management of the region. We hope that interests of the Zieleniec inhabitants will be taken into account during further proceedings.

The GWW team composed of: Joanna Sebzda-Załuska, attorney, Dorota Chramęga, attorney, Roksana Waltrowska, trainee attorney, and Marta Banasiak, trainee attorney, has been representing the group of the Zieleniec inhabitants in this complicated case for over 1.5 years.

Consequences of failure to report information to the Register of Real Beneficiaries

A taxpayer removed from register may continue to operate

Starting from September 2019, the deadline for submitting “zero-amount” tax returns has been reduced from 6 to 3 months. After this time, a head of the tax office shall remove entities from the register of active VAT taxpayers, in accordance with Article 96 paragraph 9a item 2 of the VAT Act. What effects will this change bring for taxpayers? This question is answered by Zdzisław Modzelewski, tax advisor, partner of GWW Tax, in an interview with Katarzyna Jędrzejewska in today's issue of Dziennik Gazeta Prawna.

A misled investor may withdraw from the company

Some people take up shares in a company following negotiations with company's management board, for example in exchange for an in-kind contribution. Afterwards it turns out that they were misled as to the company's financial standing. Can they then cancel their declaration of intent to take up shares?

Granting of scholarships to children of the Dorastaj z Nami (Grow Up With Us) Foundation

Last Thursday, on 12 September 2019, there was a ceremonial granting of scholarships to 26 charges of the Dorastaj z Nami Foundation by the President of the Republic of Poland Andrzej Duda and the First Lady Agata Kornhauser-Duda. Scholarships were granted to new charges of the Foundation – children whose parents died or were injured while performing their duties.

During the scholarship award ceremony at Belweder, GWW was represented by Joanna Sebzda-Załuska, legal counsel, managing partner of GWW Legal. The GWW Law Firm is a founder and substantial partner of the Dorastaj z Nami Foundation.

InternetBeta 2019 – 11th edition

GWW Law Firm is once again present on InternetBeta!

Third-party liability of a building supervision inspector

In the September issue of the Inżynier Budownictwa monthly, we will find the article on Third-party liability of the building supervision inspector by Michał Sękowski, legal counsel, partner, and Marta Lipińska, legal counsel trainee.

A contract for performing investor supervision should be qualified as a contract for the provision of services referred to in Article 750 of the Civil Code. Contracts of this type assume the pursuit of a certain result, however a contractor acting with due diligence – in the event of failure to achieve the purpose of the contract – shall not be liable for non-performance or improper performance of an obligation.

‘Changes in VAT 2019’ Conference

In the forthcoming months, we will face a number of changes in the field of VAT. The first of them will come into force on 1 September this year. Subsequent ones will be effective starting from 1 November this year and 1 January 2020. What are these changes and how will they affect taxpayers?

The introduced changes will concern a number of VAT areas and therefore will apply to taxpayers from many industries. The most important among them include:

  • the need for a large group of taxpayers to use the split payment mechanism
  • introduction of a VAT matrix and the possibility of obtaining Binding Tax Rate Interpretation
  • introduction of the so-called White Paper of VAT payers
  • new, previously unknown rules for documenting intra-Community transactions
  • introduction of new solutions for deliveries using consignment warehouses (call-of-stock).
