The importance attached to infrastructure investments and the volume of funds associated with them require the highest level of expertise and experience. We advise on rail, telecommunications, road, gas pipeline and other projects related to meeting the public’s universal needs.

Scope of support

• We provide legal assistance to all participants in the construction process (contractors, subcontractors, investors, inspectors and designers).
• We take an active part in negotiations between the parties to the investment process, particularly with regard to valorisation, changes to the completion date, settlement of additional and replacement works and overheads associated with extending the completion date.
• We draft, review and negotiate the provisions of construction contracts, subcontracts, design work contracts, author’s supervision contracts, investor’s supervision contracts and contracts with the contract engineer.
• We advise on the resolution of disputes arising in the context of the implementation of contracts related to the construction process at all stages – from the initial assessment of the claim through the conduct of settlement negotiations to the representation of clients before a court of law, including investments carried out on the basis of the contractual conditions of the International Federation of Consulting Engineers (FIDIC).
• We advise on economic and moral rights and on negotiating the provisions of licensing agreements in infrastructure contracts.
• We represent clients in administrative court proceedings concerning obtaining decisions issued based on so-called special laws, in particular, regarding the implementation of railway, road, telecommunications, fuel and airport investments.
• We advise clients on the regulation of the title to real estate in proceedings concerning the expropriation of real estate, as well as those concerning the determination of the appellation and the obligation to redeem so-called residuals.
• We conduct comprehensive legal audits of investment projects.
• We advise on the handling and settlement of funds from the European Union and the European Investment Bank.

Many familiar national infrastructure projects will have been advised on by our lawyers. As we have recently calculated, the value of construction contracts drawn up by us or agreed upon by us currently amounts to approximately PLN 20 billion.
