West House office block sold in Wrocław

Selling West House 1B is the Archicom Group’s third transaction in the Lower Silesian capital on which GWW has advised. It is at the same time a further transaction whose subject is office real estate located outside Warsaw, and in which the Wrocław GWW team has been involved.

The team, headed by Paweł Wójcik, specialises in real estate projects, along with providing comprehensive legal assistance for businesses. It also advises on construction investments, purchase and sale of real estate, and investment processes concerning telecommunications infrastructure. The team’s clients include the largest developers in the region, as well as domestic and international companies doing business in Lower Silesia.

GWW’s tax practice rated best in Poland

It gives us great pleasure to announce the success of GWW’s tax practice in Dziennik Gazeta Prawna’s ninth annual survey. Wed like to thank our clients for their confidence in us!

Among firms with at least 10 tax advisors, GWW won two awards:

  • 1st place – in the category of “best firm”, i.e. those that had the greatest achievements last year, and
  • 2nd place – in the category of “most effective firm”, measured by indicators such as revenue per professional staff member and success in disputes before tax authorities.

 

The best tax advisors were also ranked. Among them was Artur Cmoch, one of the partners heading GWW’s tax practice, who took 2nd place in the “international tax law” category.

This adds to Artur’s two earlier awards, in the categories of “tax optimisation” (2014) and “income tax” (2011).

InPost wins dispute with former postal monopoly

On 23 January 2015 the Warsaw Regional Court rejected Poczta Polska’s complaint against a ruling by the National Appeals Chamber (KIO) in a tender to provide mailing services for the Agricultural Social Insurance Fund (KRUS). The team of GWW attorneys engaged in the project was led by Krystian Szostak, the partner responsible for GWWs litigation practice. 

–  “After hearing the appeal against the National Appeals Chamber’s ruling, the court ruled that InPost was in the right,” says Kryistian. “The company is making further inroads into the market of postal services for public institutions, which will save millions of zlotys for Polish taxpayers.”

GWW represented InPost before the National Appeals Chamber concerning a tender to deliver correspondence for the Agricultural Social Insurance Fund, as well as in an appeal before the Regional Court in Warsaw.

Krystian Szostak led the team of GWW lawyers, comprising: Paweł Rożyński, an expert in public procurement and PPP issues, and Katarzyna Blachowicz, an attorney-at-law (radca prawny).

Netia wins 81.5 million zloty tax dispute

After four administrative court rulings, on 29 December 2014 the Director of the Tax Chamber in Warsaw held that the company owed no corporate income tax for 2003.

Netia received a refund of 81.5 million zloty in corporate income tax and interest on 8 January 2015.

GWW Tax experts advised the Company on preparing the winning strategy for recovering overpaid CIT, during appeal proceedings before the tax authorities and in proceedings before administrative courts: the Province Administrative Court in Warsaw and the Supreme Administrative Court.

GWWs victory in the postal tender

This ruling means that the PGP Group will continue delivering letters from courts and prosecutors.

In considering the complaints against the KIOs decision, the court sided 100% with Polska Grupa Pocztowa and InPost; signifying that the revolution on the market for postal services is a reality, now confirmed by a legally binding court ruling” commented Krystian Szostak, the GWW partner who heads the litigation practice and who represented PGP and InPost in their dispute with Poczta Polska.

GWW represented the companies in proceedings before the National Appeals Chamber concerning a tender for delivery of correspondence from common courts and prosecutors, as well as in appeals proceedings before the Regional Court in Kraków. The contract was worth close to 500 million zlotys. GWW was Polska Grupa Pocztowas legal advisor at every stage of the proceedings, providing guidance to the Client during the entire process of appealing the result of the tender.

The team of GWW attorneys engaged in the project was led by Krystian Szostak, the partner responsible for GWWs dispute resolution practice and a “recommended attorney” for litigation and arbitration cases, according to the prestigious Chambers Europe ranking. GWW Tax reaches the top 10 in its field

Since 2010, our tax advisors have steadily improved their position in all ranking lists — an effort that has culminated in the inclusion of GWW Tax among the top 10 advisory firms in Poland. Notably, in the Rzeczpospolita ranking, were competing not just with law firms, but also with firms including the Big Four.

GWW achieved the following positions in sub-rankings:

  • quantitative – we advanced to 10th place from 11th (up from 13th two years ago)
  • revenue – first place among law firms and a rise to 11th place from 13th in the overall ranking
  • qualitative – a strong substantive performance, as demonstrated by a list of the leading transactions and cases, as well as our client list.

The Rzeczpospolita ranking builds on achievements by GWWs tax practice, which operates under the GWW Tax brand, and which reached leading positions in earlier surveys this year. In March we were listed among the top five in the ranking of the most effective tax advisory firms and among the best tax advisory firms in the 8th edition of Dziennik Gazeta Prawna newspapers prestigious Ranking of Tax Firms and Advisors.

In that same ranking, our tax advisors reached the medal stand with individual awards in three categories. Were especially proud of Andrzej Próchnicki, ranked No. 1 in the income tax category. More about his award.

Ideal Employer 2014

Were delighted to announce that GWW took 4th place among law firms and 9th place among legal and advisory firms in the Legal category of the Ideal Employer 2014 ranking, according to the 2013-14 Universum Student Survey.

The result shows that according to current law students, were part of a small group of the most desirable employers in the field of professional services.
In the Legal category, students selected 50 firms that they see as being worthy of the title of ideal employer — a list that included just seven “classic” law firms. The top three places were taken by EY, Google Poland and the TVN television network.

The ranking also shows that law students find firms that offer high compensation and good career prospects to be the most attractive. Companies that value their employees and offer environmentally friendly workplaces are also in demand.

The ranking was compiled by Universum, an international consulting firm that specialises in employer branding. More information is available on Universums website.

Andrzej Próchnicki among the ranks of best advisors

Andrzej Próchnicki wins first place in the Income Tax” category. The justification reads “(…) The team lead by this advisor contributed to working out optimal tax solutions pertaining to the principles and dates of recognising tax deductible costs on account of interest, commission and costs of advisory services on significant amounts of external financing. The most significant task that Andrzej Próchnicki had to deal with was the issue of tax succession and the possibility of its application with reference to the acquiring company in the merger of two entities. (…)”

At the same time, the following also figured amongst the ranks of the best tax advisors:
Article Cmoch – second place in the “Tax Optimisation category”;
Leszek Białoń – third place in the “Mergers and Acquisitions” category.

This means that GWW is ranked among the leaders when it comes to individual distinctions awarded to tax advisors.

Furthermore, GWW’s tax practice, run under the GWW Tax brand, has unfailingly been in the top five in the category “Most Effective Tax Advisory Firms” since 2010, and was “Best Tax Advisory Firm 2011”. This category in the current edition sees us in fourth and fifth place respectively in the large companies group (employing 10 or more tax advisors). 

75 of the best and most dynamic advisory firms on the market took part in the VIII Ranking.
