Pre-pack, i.e. bankruptcy under control

Bankruptcy procedure is associated with a tedious and lengthy procedure aimed at ending business activities of an indebted entity. Its effects are usually not satisfactory for any of parties. The bankrupt loses its assets and ceases activities, whereas creditors recover a negligible part of their claims.

However, changes in the bankruptcy procedure that relate to prepared liquidation (so-called pre-pack) are perceived positively. The advantage of the prepared liquidation is the possibility of accelerated disposal of bankruptcy estate and recovering funds to satisfy creditors.

More and more problems with issuing receipts

Regulations on issuing receipts for transactions of a lower value than PLN 450 caused more harm than good. Tax authorities issue conflicting interpretations, whereas sellers and their customers do not know what to do.

Expenses on an interrupted project can be deducted from revenues

The situation of the coronavirus epidemic may disrupt plans related to the company's development. However, the latest interpretation of the tax authorities clearly confirms that expenses related to a planned listing on the stock market are costs indirectly related to revenues, even in a situation where the implementation of these plans is suspended. Therefore, they can be deducted from revenues.

12th Public Finance Forum

In the second week of October, Toruń will host the 12th Public Finance Forum, the theme of which is: What to pay attention to at the closing of 2020 – doubts regarding accounting, reporting, and public finance discipline in the times of the pandemic. 

Grzegorz Karwatowicz, an expert in the field of EU funds, public aid and public procurement practice, will be one of speakers at the event. During his lecture, he will discuss the most important problems related to the implementation of EU projects, taking into account the impact of COVID-19 on the course of project implementation.

The 12th Public Finance Forum is the largest event in Poland addressed to financial and accounting staff of entities of the public finance sector. It aims at providing participants with practical solutions to problems they encounter in their work. Topics discussed during the conference will be devoted to sensitive areas in law.

Current challenges in the field of energy land and real estate taxation

On 12-13 October 2020, a series of interactive workshops will be held at the Westin Hotel in Warsaw entitled Current challenges in the field of energy land and real estate taxation in the new regulatory environment. The event will be held in the live streaming form. The aim of the workshops is to brief participants on changes in the scope of new regulations that have a direct impact on the taxation of energy real estate and equipment. The meeting is directed primarily to professionals from the energy and gas industries.

The first day of the workshops will start with a presentation by Kamil Szczęsny, lawyer, supervisor of tax practice at GWW, który who will present issues of real estate taxation of selected network structures and energy equipment to participants, by discussing:

  • issues of land related to conducting a business activity and occupied for conducting such activity
  • taxation of energy equipment: cable lines, wind farms, transformers, temporary building structures and photovoltaic structures, water supply networks, energy distribution stations

Successful training for the Polish Association of Developers

Yesterday's webinar organized by the Polish Association of Developers on the amendment to the Construction Law that enters into force on 19 September 2020, conducted by Joanna Sebzda-Załuska, broke the attendance record! It was participated by more than 200 people.

During the webinar, Joanna Sebzda-Załuska presented the new regulations and the reasons for introducing them, and most of all, made an attempt to assess their anticipated impact on a construction investment process and its participants. She gained professional experience by working in construction supervision authorities and in the GWW Law Firm, she provides advice to investors during the investment process. 

She is an author of numerous publications on changes required in the applicable legal regulations in order to enable elimination of legal barriers and ensure smooth implementation of investment projects. Tax relief applicable only to the first cash register

Development of a company, expansion of business activities and purchase of additional cash registers no longer entitle to the tax relief for the purchase of the device. The tax relief may be applied only to those registers that a company bought at the start its business. Tax authorities’ opinion is firm. However, tax advisers believe that the relief should be applied to a wider extent.

Expansion of the Rzeszów branch of GWW

“Yellow card” for investors, i.e. illegal use of a building structure after amendments to the Construction Law

Renata Siekanko, a specialist in construction law, writes about changes in the procedure regarding illegal use of a building structure, which were introduced as part of the amendment to the Act on Construction Law.

– First of all, the previous nature of a penalty imposed in these proceedings will change – from a one-off penalty to a multiple possibility of imposing it. This possibility will be effective until the building structure is used on the basis of a use permit decision or an effective notification of construction completion – writes Renata Siekanko.
