Public procurement

Statistics say that Polish entrepreneurs have grown fond of this market and benefit from its competitiveness. This can be seen from the number of appeals to the National Appeal Chamber – we ourselves have represented contracting authorities and contractors before the NAC as many as 250 times. What must be admitted, however, is that this is a market with a lot of formalities and restrictions.

We are happy to tackle these difficulties; our procurement team is made up of passionate people who can wade through hundreds of pages of construction documents without a hitch.

We support contracting authorities both at the stage of preparing the documentation for a public procurement procedure and during the procedure (e.g., analysis of bids, preparation of summons, opinion on exclusion of a contractor from the procedure, and opinion on cancellation of the procedure). We have advised on public procurement proceedings more than 1,000 times.   We also support contractors in tender proceedings (e.g., analysis of tender documentation, preparation of requests for clarification of the Terms of Reference, conclusion of a consortium, formal and legal verification of a bid, and formal and legal verification of competitive bids). This gives us an overview of the situation from both sides, and we know what the other side usually expects.

• We represent contracting authorities and contractors in appeal proceedings before the National Appeal Chamber and in complaint proceedings against Chamber judgments.
• We support contracting authorities and contractors in the execution of public procurement contracts, including at the stage of contracting with subcontractors, amendments to public procurement contracts or their early termination.
• We support contracting authorities with in-house procurement.
• We support contracting authorities in the preparation of internal acts regulating the organisation of procurement procedures.
• We support contracting authorities in the choice of legal instruments in the implementation of significant infrastructure projects (choice of implementation models such as public-private partnership, concession for works or services, public procurement).

We regularly provide training on the application of public procurement law either at open conferences or directly to the client.

Public procurement is not a subject that can be successfully handled by every lawyer – the specifics of this branch of law require the work of people with specialised knowledge and experience.
