Tax workshops: changes in VAT for 2014

The new VAT regulations are effective as of 1 January 2014. The amendments mostly concern the tax point, the provisions referring to the right to deduct and issue invoices. The amendment, which came into force this year, is a continuation and supplement to the changes that began on 1 January 2013 when new provisions covering invoices were introduced.

All these changes are interconnected and jointly amend the elementary principles of the Polish VAT system that have been in place for more than 20 years.

Despite the new regulations being seemingly clear and precise, their application in practice may be fraught with difficulties. This is caused by the fact that the new provisions will be seen in terms of the VAT Act in the interpretation effective to date, which both taxpayers and tax authorities have gotten used to.

Additionally, probably in March of this year, new provisions on deducting car VAT will come into force. The new deduction mechanism will be introduced, resulting in new restrictions and new possibilities.

A National Competition on a judicial gloss to a ruling in a tax case

The Competition is organised by the Tax Law Student Club at the Department of Public Finance Law of the Faculty of Law and Administration at Nicolaus Copernicus University in Toruń. 

Prof. dr hab. Bogumił Brzeziński is the Competition originator, the Clubs Academic Mentor. The Competition is open to Law and Administration Faculties throughout the country.

Glosses will be assessed by a jury composed of:

  • prof. dr hab. Bogumił Brzeziński − Jury Chairman (UMK, UJ);
  • prof. dr hab. Hanna Litwińczuk (UW);
  • prof. dr hab. Wiesława Miemiec (UWr);
  • prof. dr hab. Adam Nita (UJ);
  • prof. dr hab. Zbigniew Ofiarski (USz);
  • dr Agnieszka Olesińska (UMK). 

This presents the students with an excellent opportunity to enter the fascinating world of professional business advice and start down the tax advisor career path. The first prize includes a month-long paid internship at GWW Tax.

Dziennik Gazeta Prawna law firm ranking – 2013 issue

A group of chain law firms did not take part in the 9th edition of the DGP ranking, deciding that they will not provide certain financial data. Thus, in comparison to the previous year, the Ranking is poorer when it comes to the number of participants.

Points are awarded in seven categories, determining a firm’s position in the ranking: – Revenue per specialist person; – Number of employees with entitlements; – Number of employees without entitlements; – Time on the Polish market; – Number of cases won in front of the courts / international organisations; – Number of appeals won; – Foreign languages in which clients are serviced.

This edition introduced a grouping of the firms by size and presentation of the leaders in three groups “up to 20 employees”; “from 21 to 50 employees”; “large law firms, more than 51 employees”.

A separate listing was made for “Law firms with the highest revenues per lawyer”.

Legal 500 – 2013 edition

This years international Legal 500 ranking, which summarised 2012 and was published on 27 March 2013, the GWW team of lawyers providing legal advice to the telecommunication, media and new technologies (TMT), was the only one that received the highest scores and came in first place among the best tax advisors.
 
This means that, in the opinion of B2B and competition sector representatives, GWW has the best TMT practice in Poland.
Our TMT team has been described as “exceptionally effective” and appreciated for the “arsenal of skills” at its disposal and its “phenomenal knowledge of regulatory issues”.
Individual recognitions within the team were awarded to:
 
1. Piotr Woźnythepartner managing this practice, who has unfailingly received the title of leader for a number of years. The edition underlined his ‘incredible business intuition’;

Chambers Global 2013 recommends our practice for Corporate/M&A

In the Chambers Global: The Worlds Leading Lawyers for Business ranking published on 14 March 2013 the GWW law firm was again recommended in the Corporate/M&A sector. At the same time, Tomasz Maliński, managing the practice, was singled out as a recommended lawyer (Department head Tomasz Malinski is the go-to person at this firm).

EU projects financial corrections

GWW Legal is the content-related patron for the “Financial corrections in EU projects – beneficiaries legal remedies” conference taking place on 18 April 2013 at the Faculty of Pharmacy at the Wrocław Medical University. 
 
The conference is organised by the Wrocław Medical University (UWM) with GWW Legal acting as the content-related patron of the event.
 
In recent months, beneficiaries of EU funds are subject to control procedures that often entail financial corrections being applied, obliging them to return a significant part of the obtained and expended funds. The scale and dimension of these actions, the lack of clear provisions of law regulating these issues and differences in court case law have persuaded UWM to organise a subject-based conference participated by experts and beneficiaries.
 
Participation in the conference will present an excellent opportunity to discuss significant issues associated with financial corrections and the consequences of questioning the correct use of EU funds.
 
Participation is free of charge for individuals managing public finance sector entities.
 
During the conference, GWW Legal experts, who are conducting a number of proceedings pertaining to the application of financial corrections where they represent local governments, universities and businesses, will present the following issues:
 
  • An assessment of authority practices within the scope of determining and applying financial corrections and demands for the return of funds received as part of project co-financing.
  • Legal aspects and problems in qualifying determined legal irregularities while simultaneous highlighting the irregularities, which should not result in a demand to repay funds or a termination of the project co-financing agreement.
  • Legal protection that beneficiaries are entitled to in a situation where a financial correction is determined and applied followed by a demand to repay funds.

Telecommunication buildings investments

Joanna Sebzda-Załuska will represent GWW Legal during the “Telecommunication buildings investments – legal regulations and the construction-environmental dimension” conference, which will take place on 4-5 April 2013 in Warsaw.

Workshops are an excellent opportunity to both acquire knowledge from environmental and planning experts, as well as to exchange experiences. The aim is to acquaint participants with the possibilities of effectively speeding up the investment process, discussion of the most important barriers and restrictions stemming from the legal regulations in force within the telecommunications sector, as well as issues within the scope of acquiring real property for telecommunications purposes.

On day two of the workshops, Joanna Sebzda-Załuska, attorney at law, GWW Legal partner, will present a lecture entitled “Application of the Act on Promoting the Growth of Telecommunication Services and Networks in practice – acquiring real property for telecommunications purposes.”
