Tax on building revenues to be paid later but in what amount?

The Anti-Crisis Shield 1.0 postponed the payment of the minimum commercial real estate tax for the months from March to May until July 20. However, shopping centre owners are wondering whether they have to pay this tribute at all for the period when their activity was top-down limited.

NSA allows delaying VAT refunds

Tax offices use various tricks and laconic justifications to prolong proceedings and delay VAT refunds. Taxpayers cannot even predict when they will receive their money, since tax offices set themselves new deadlines, which they still do not meet. According to a judgment of the Supreme Administrative Court issued a few days ago, the mode of operation applied by the offices is correct.

GWW’s success in public procurement law

Grzegorz Karwatowicz, of counsel, an expert in public procurement law, obtained elimination by the National Board of Appeal of the prohibition to conclude a public procurement contract for our client Teatr Ludowy in Krakow. This is even a greater success due to the fact that, as the National Board of Appeal has many times ruled, elimination of the prohibition to conclude a contract is an exceptional institution which should not, in principle, be generally applicable.

GWW support VentilAid – the creators of the „last chance ventilator”!

We are proud to inform that GWW Law Firm is a legal partner of the VentilAid initiative, which supports the fight against the COVID-19 coronavirus pandemic by using technology.

How does it work? A group of engineers and designers decided to create a device having a function of a respirator as a tool to combat the effects of the COVID-19 disease. Ventilaid is a device aimed at relieving medical staff and save as many patients as possible. Owing to its unique parameters, it can be quickly implemented for mass production and due to low costs – also in the poorest countries. VentilAid is currently at the stage of medical tests of a new respiratory prototype, cheap to manufacture, and widely available.

The GWW team of intellectual property practice and new technologies supports VentilAid in the field of copyright and industrial property rights.

Time limits in the new public procurement law

The new public procurement law introduces some partly new rules for calculating time limits in public procurement procedures. They require parties to be more scrupulous and – at least at the beginning of applying the same – to act with greater caution. Introduction of time limits calculated in hours is important innovation.

Legal webinar for the Polish Association of Developers

Just before the May weekend, on 30 April this year, a first meeting of the Legal Group at the Branch of the Polish Association of Developers in Wrocław took place.

The issues touched upon during the meeting concerned administrative as well as court and administrative procedures during the coronavirus pandemic. The training was conducted by Joanna Sebzda-Załuska, attorney-at-law, managing partner of GWW. Anna Leszczyna, attorney-at-law, Deputy of the Poviat Building Supervision Inspector for the city of Wrocław, was a special guest .

Over 40 people attended the meeting held in the form of a webinar.

A municipality that helps its taxpayers will lose financially

If a municipality waives certain amounts due to it from a company, such as a real estate tax, it will lose twice. It will not get the tax and will receive less money as part of a subsidy. This is the principle the government wants to introduce in the next version of the anti-crisis shield regulations. The poorest municipalities will lose the most on this change. On the other hand, the regulations that are already in force provide that a local government must pay VAT in the case of releasing tenants from rent. According to experts, this is absurd.

Despite the fact that a landlord cannot require a tenant to make payments of rent during the trade prohibition, it should, nevertheless, issue rent invoices on a regular basis during the trade prohibition, pay VAT on such invoices, and disclose revenues – Małgorzata Militz emphasizes.
