New partners of the tax practice of GWW

We are happy to announce that Aldona Leszczyńska-Mikulska and Małgorzata Militz joined the group of tax practice partners of GWW.

Below, you will find an outline of information about Aldona and Małgosia.

Aldona Leszczyńska-Mikulska manages an advisory team for individual clients, covering the following areas: family companies and planning succession, and individual clients. Aldona specializes in international tax planning and international inheritance planning. She advises her clients in matters and disputes concerning their private assets, in family matters and in marital property matters. She participates in processes connected with generation changes in family companies. She holds top positions in international rankings in the category of Private Client (e.g. Chambers Europe 2017, 2018), she is a member of the STEP Association and International Fiscal Association.

Małgorzata Militz is responsible for the following areas: tax disputes, VAT, excise tax and customs duties. She specializes in proceedings connected with tax on goods and services. Within the framework of her on-going advisory services, she provides advice on tax on goods and services; she issues tax opinions, she conducts tax audits, represents clients in tax and customs-revenue controls, before tax authorities of both instances and administrative courts, in proceedings concerning tax on goods and services. She holds high positions in tax rankings (e.g. the ranking of Dziennik Gazety Prawnej in the category of VAT 2017, 2018; the ranking of International Tax Review: Woman in Tax Leaders 2017 and Indirect Tax Leaders 2017).

BTC conference: Bitcoin, token, cryptocurrency

GWW is a partner of the BTC Conference: Bitcoin, token, cryptocurrency, which will be held on 8 September of the current year in Rzeszów. 

The lecturer at the conference will be Attorney Aldona Leszczyńska-Mikulska. The topic of her speech will be the Planned tax changes which may affect cryptocurrency investors.

During the lecture, we will present the impact of the most important planned or recently-introduced tax changes on the activity of cryptocurrency investors. We will also demonstrate how the changes introduced so far may affect the tax settlements of investors for 2018. In particular, we will deal with:

– temporary exemption of trade in cryptocurrencies from legal-civil tax (PCC)
– “solidarity donation”, i.e. an increase of taxes for the richest
– exit tax – tax for those who wish to change their tax residence
– settlement of tax for 2018 by foreign investment companies

Attorney Joanna Sebzda-Załuska comments upon the objections against the special housing act

In today’s issue of Rzeczpospolita, Attorney Joanna Sebzda-Załuska discusses objections against special housing act in the article entitled “Lex developer isn’t so bad after all ". She comments upon the social factor in the process of development of the investment and she reassures us:

A resolution on determination of location or refusal to determine the location of investments will be adopted by the communal council upon an analysis of a complete application submitted by the vogt (a mayor, a president of a city), including all opinions, comments and arrangements. What is more, until the time of adoption of a resolution, the investor may modify the application, in particular, taking into account the submitted comments. Therefore, it is difficult to agree that social consultations regarding this act are only a fake,” emphasises Attorney Sebzda-Załuska.

And she reminds us that even though at present, at the stage of adoption of local spatial plans, there is a detailed procedure in place for submission and consideration of objections, this does not directly affect the contents of the adopted resolution.

It often happens that the local spatial plan is adopted in the wording which does not take into account any comments,” points out the expert.
