Attorney Joanna Sebzda-Załuska comments upon the objections against the special housing act
In today’s issue of Rzeczpospolita, Attorney Joanna Sebzda-Załuska discusses objections against special housing act in the article entitled “Lex developer isn’t so bad after all ". She comments upon the social factor in the process of development of the investment and she reassures us:
“A resolution on determination of location or refusal to determine the location of investments will be adopted by the communal council upon an analysis of a complete application submitted by the vogt (a mayor, a president of a city), including all opinions, comments and arrangements. What is more, until the time of adoption of a resolution, the investor may modify the application, in particular, taking into account the submitted comments. Therefore, it is difficult to agree that social consultations regarding this act are only a fake,” emphasises Attorney Sebzda-Załuska.
And she reminds us that even though at present, at the stage of adoption of local spatial plans, there is a detailed procedure in place for submission and consideration of objections, this does not directly affect the contents of the adopted resolution.
“It often happens that the local spatial plan is adopted in the wording which does not take into account any comments,” points out the expert.
